Kuwait Gratuity After Resignation: What You Get
Written by Usama Afzal, Founder & Editor, GratuityHisab. Last updated: October 2026. Based on the Kuwait Labour Law; not legal advice.
Kuwait gratuity after resignation is not the full amount — Article 53 of the Kuwait Labour Law cuts it into brackets: under 3 years = nothing, 3–5 years = half, 5–10 years = two-thirds, 10+ years = the full gratuity. So timing your resignation matters enormously: resigning at 4 years and 11 months costs you a sixth of your gratuity versus waiting one more month. Worked examples below.
Kuwait gratuity after resignation: the Article 53 brackets
When your employer ends your contract, you get the full Kuwait gratuity calculation. But when you resign, Article 53 applies these reduction brackets to your total:
| Service at resignation | You receive |
|---|---|
| Under 3 years | Nothing (0%) |
| 3 to 5 years | Half (50%) |
| 5 to 10 years | Two-thirds (66.67%) |
| 10 years or more | Full (100%) |
These brackets apply to the full gratuity figure from the Kuwait gratuity calculation formula — (basic ÷ 26) × 15 days for the first 5 years, then one month per year after, capped at 18 months.
Worked example 1: KD 400 basic, 6 years, resigned
- Full gratuity first. Daily wage = 400 ÷ 26 = KD 15.3846. First 5 years: 15 × 15.3846 × 5 = KD 1,153.85. Year 6: 1 × 400 = KD 400. Full total = KD 1,553.85.
- Apply the bracket. 6 years falls in the 5–10 year bracket → two-thirds: 1,553.85 × 2 ÷ 3 = KD 1,035.90.
- What resignation cost: KD 1,553.85 − KD 1,035.90 = KD 517.95 lost by resigning instead of being terminated.
Worked example 2: KD 400 basic, 4 years, resigned
- Full gratuity: 15 × (400 ÷ 26) × 4 = 15 × 15.3846 × 4 = KD 923.08.
- Bracket: 4 years → 3–5 year bracket → half: 923.08 ÷ 2 = KD 461.54.
- The painful comparison: resign one year later (5 years) and the bracket jumps to two-thirds of KD 1,153.85 = KD 769.23 — over KD 300 more for 12 extra months.
When resignation does NOT reduce your gratuity
The brackets apply when you resign voluntarily. They do not apply if your employer terminates you, if your fixed-term contract simply expires, or in cases of constructive dismissal (for example, the employer forcing you out). In those cases you keep the full Kuwait gratuity calculation. If your employer pressures you to ‘resign voluntarily’ to trigger the brackets — a common trick — that resignation may not be truly voluntary under the law.
Employer refusing to pay after your resignation?
Some employers use the brackets as an excuse to pay nothing at all, or ‘forget’ the two-thirds rule. Your gratuity after resignation is still a legal debt. Steps: (1) demand the exact bracketed amount in writing, showing the Article 53 calculation; (2) keep copies of your contract, payslips and resignation acceptance; (3) file a complaint with the Kuwait Public Authority for Manpower if payment is withheld. Our Kuwait notice period guide also covers the 3-month notice you usually owe when resigning — skipping it can trigger separate deductions.

Frequently asked questions
Do I get gratuity if I resign in Kuwait?
Yes, but reduced by Article 53 brackets: under 3 years of service you get nothing, 3–5 years gives half the full gratuity, 5–10 years gives two-thirds, and 10+ years gives the full amount. The brackets apply to the full Article 53 calculation: (basic ÷ 26) × 15 days for the first 5 years, then one month per year after.
I resigned after 4 years in Kuwait. How much gratuity do I get?
Half of your full gratuity. Example on KD 400 basic: full gratuity = 15 × (400 ÷ 26) × 4 = KD 923.08; half = KD 461.54. The 3–5 year bracket pays 50%.
Does the employer have to pay gratuity if I resign?
Yes — the bracketed amount is a legal entitlement, not a favour. If your employer refuses, demand it in writing with the Article 53 calculation and complain to the Public Authority for Manpower.
Do probation months count toward the resignation brackets?
Yes. Your service period is continuous employment with the same employer from your joining date, including probation. Unpaid absence days may be excluded, so confirm exact dates with HR near a bracket boundary.
Is it better to wait until 5 years before resigning in Kuwait?
Usually yes. The bracket jumps from half (3–5 years) to two-thirds (5–10 years). On a KD 400 basic salary that jump is worth over KD 300 — and the jump from two-thirds to full at 10 years is even bigger. Check your exact dates before deciding.
