How much end-of-service indemnity will you get in Kuwait?
Calculated under Articles 51 and 53 of Kuwait Labour Law No. 6 of 2010. See what 15 days a year for the first 5 years adds up to — and how resigning changes your share.

Kuwait indemnity rules at a glance
| Service | If you resign | If the employer ends it or the contract expires |
|---|---|---|
| Under 3 years | none | full |
| 3 to 5 years | half | full |
| 5 to 10 years | two-thirds | full |
| 10 years or more | full | full |
| Serious misconduct | – | none |
Indemnity = (15 days × daily wage × first 5 years) + (1 month’s basic × years after 5). The daily wage is your monthly basic ÷ 26. The total cannot exceed 18 months’ basic salary. Part-years count proportionally.
A worked example
Say your basic salary is KWD 500 and you resign after 6 years. Your daily wage is KWD 19.23. The first 5 years give 15 × 19.23 × 5 = KWD 1,442.25; the 6th year gives one month’s basic, KWD 500. The full award is KWD 1,942.25, but resigning with 6 years means two-thirds: KWD 1,294.83.
If the employer had ended your contract instead, you would keep the full KWD 1,942.25 — and resigning before 3 years gives nothing at all.
Common questions
Do I get gratuity if I resign in Kuwait?
It depends on your service. Resigning with under 3 years gives nothing; 3–5 years gives half the award; 5–10 years gives two-thirds; 10 years or more gives the full award (Article 53). If the employer ends your contract, you get the full award whatever your service.
How is the daily wage worked out?
Divide your monthly basic salary by 26 (the standard working days in a month). So KWD 500 a month is KWD 19.23 a day, and 15 days a year is KWD 288.45 a year for the first five years.
Is there a maximum?
Yes. The total indemnity cannot exceed 18 months’ basic salary (one and a half years’ wage) for monthly-paid workers.
Are allowances included?
No. Article 51 bases the indemnity on your basic wage. Overtime, commissions and allowances are not included unless your contract says otherwise.
What if my employer refuses to pay?
You can file a complaint with Kuwait’s Public Authority for Manpower. Keep your contract, salary slips and any termination letter — claims should be filed within one year.
Is this an official calculation?
No, it’s an estimate based on Articles 51 and 53 of Labour Law No. 6 of 2010. The employer may deduct amounts you owe it, such as loans. For a binding figure, contact the Public Authority for Manpower or a lawyer.
