UAE gratuity rules at a glance
| Service | If you resign | If the employer ends it or the contract expires |
|---|---|---|
| Under 1 year | none | none |
| 1 to 5 years | 21 days a year | 21 days a year |
| After 5 years | 30 days a year | 30 days a year |
Gratuity is based on your last basic salary: 21 days a year for the first 5 years, then 30 days a year. Part-years count proportionally, unpaid absence doesn't count, and the total can't exceed 2 years' salary.
A worked example
Say your basic salary is AED 3,000 and you resign after 4 years. Your daily basic wage is AED 100, 21 days a year is AED 2,100, and 4 years of gratuity is AED 8,400.
Work 7 years and you get AED 10,500 for the first 5 years plus AED 6,000 for the next 2: AED 16,500 in total. Resigning brings no reduction in the UAE.
Common questions
Do I get full gratuity if I resign in the UAE?
Yes. The law in force since February 2022 removed the resignation reductions. After 1 year of continuous service, you get the full gratuity whether you resign or the employer ends the contract.
Is housing allowance included?
No. Gratuity is calculated only on your last basic salary; allowances like housing and transport aren't included.
How soon must the employer pay?
By law, all dues including gratuity must be paid within 14 days of the end of employment.
Do I get gratuity after an Article 44 dismissal?
Opinions differ. Article 51 doesn't link gratuity to the reason for dismissal, so many lawyers say it's still due, but some employers withhold it. If that happens, complain to the Ministry of Human Resources (MOHRE) or speak to a lawyer.
Is it the same in free zones (DIFC, ADGM)?
No. DIFC and ADGM have their own rules, and some companies have joined the government's alternative savings scheme, which replaces gratuity with monthly contributions. This calculator is for regular (mainland) private-sector jobs.
