Gratuity is based on your last basic salary, and part-years count proportionally. Resigning doesn't reduce it, as long as you serve your notice. From 19 July 2027, a savings scheme replaces gratuity for expatriates, with the employer paying 9% of basic salary each month.
A worked example
Say your basic salary is OMR 400 and your contract was signed in 2024. After 3 years your gratuity is 400 × 3 = OMR 1,200, whether you resign or the employer ends the contract.
If the same contract had been signed in 2022, under the old law, the first 3 years at 15 days a year would give 200 × 3 = OMR 600, half as much.
Common questions
Do I get gratuity if I resign in Oman?
Yes. Resigning doesn't reduce your gratuity in Oman, as long as you serve your notice period. Only a summary dismissal for serious misconduct under Article 40 removes it.
Is housing allowance included?
No. Gratuity is calculated on your last basic salary; allowances aren't included.
My contract is from before 2023. Which formula applies?
Under the Ministry of Labour's August 2026 clarification, contracts concluded under the old law get 15 days for each of the first 3 years and then a month per year. Some employers instead split service at 31 July 2023. Ask your employer for a written calculation.
What is the 2027 savings scheme?
From 19 July 2027, a mandatory savings scheme replaces gratuity for expatriate workers. The employer will pay 9% of your basic salary each month into the Social Protection Fund, paid out when your employment ends. Detailed rules are still to come.
