Short answer

Your Kuwait final settlement is more than just gratuity. Before you sign anything or leave the country, make sure you receive 10 things: your end-of-service gratuity (Article 51), cash for unused annual leave (Article 73), unpaid salary and overtime, notice-period pay, your end-of-service certificate (Article 54), your passport and deposited documents back, and payment within 2 weeks of your last day. On a KD 600 salary with 8 years' service and 12 unused leave days, the full Kuwait final settlement is KD 3,807.69 — the complete checklist is below.

1. End-of-service gratuity (Article 51)

The heart of every Kuwait final settlement. Article 51 of Labour Law No. 6 of 2010 gives monthly-paid workers 15 days' wages per year for the first 5 years and one full month per year after that, capped at 18 months' salary. Daily wage = basic salary ÷ 26. On KD 600 basic with 8 years: (600 ÷ 26) × 15 × 5 = KD 1,730.77, plus 3 × KD 600 = KD 1,800, for a gratuity of KD 3,530.77. Run your own numbers in our Kuwait gratuity calculator — and read the full calculation guide before you accept any figure.

2. Unused annual leave encashment (Article 73)

This is the item most workers forget in their Kuwait final settlement. Article 70 gives you 30 days of paid annual leave per year, and Article 73 says any unused leave must be paid out in cash when your contract ends — you cannot be forced to waive it (Article 74). Leave pay = monthly salary ÷ 26 per day. With 12 unused days on KD 600: 12 × (600 ÷ 26) = KD 276.92 owed to you on top of gratuity. Count your leave balance from your HR records before your last day.

3. Unpaid salary, overtime and bonuses

Your Kuwait final settlement must include every fils still owed: salary for days worked in the final month, overtime (1.25× hourly rate on working days, 1.5× on rest days), and any contractual bonuses or commissions already earned. Overtime is one of the most underpaid items — estimate yours with our overtime calculator and compare against the payslip.

4. Notice-period pay (Article 44)

If either side ends the contract without serving the notice period, the other side is owed pay in lieu of notice. For monthly-paid workers the statutory notice is 3 months (Article 44) unless your contract says otherwise. If your employer terminated you without notice, 3 months' salary belongs in your Kuwait final settlement. Read our Kuwait notice period guide for the details.

5. End-of-service certificate (Article 54)

Article 54 entitles you to a certificate stating your employment period, job title and last wage. The employer may not include any remarks — express or implied — that harm you or limit your future employment. Ask for it in writing on your last week; you will need it for your next job's visa paperwork.

6. Your passport and documents back

The employer must return everything you deposited: passport, certificates, tools. Keeping your passport is a violation of Kuwaiti law — and if you resign because of such a violation, Article 48 entitles you to your full gratuity regardless of service length. Never leave the country without your documents in hand.

7. Payment within 2 weeks

Kuwait labour practice requires the Kuwait final settlement to be paid within 2 weeks of termination. If your employer delays beyond that without a valid reason, you can file a complaint immediately — don't wait months hoping it resolves itself.

8. Check every deduction

Only proven debts you owe the employer (like an outstanding company loan) can be deducted. Since Law No. 85 of 2017, the employer's social security contributions cannot be deducted from your indemnity. Any other deduction — 'admin fees', vague 'damages' — can be disputed. Ask for each deduction in writing with its legal basis.

9. Never sign a blank or unclear settlement

Pro tip: the most expensive signature of your Kuwait stay is the final settlement receipt. Never sign a blank paper, a receipt in a language you don't understand, or a document whose numbers you haven't verified yourself. Once signed, disputing the amounts becomes far harder. Take the papers home, verify every line against this checklist, and only then sign.

10. If they won't pay: complain free to MOSAL

If your Kuwait final settlement is refused or short-paid, file a free complaint with the Ministry of Social Affairs and Labour (labour department in your area, or via manpower.gov.kw). Bring your contract, salary slips and termination letter — no lawyer needed for this first step. If mediation fails, the case goes to the Labour Court. Our guide for unpaid gratuity in Kuwait walks through the whole process.
