Company not paying your gratuity in Saudi Arabia? Here's what to do

By law, the employer must settle all your dues within one week if it ends the contract, or within two weeks if you leave. If it doesn't, first ask in writing, then file a free complaint for amicable settlement with the Ministry of Human Resources (HRSD). Don't wait too long: claims are generally not accepted after 12 months from the end of the job.
Step 1: Ask in writing
Send HR a short email or letter asking for your final settlement and a breakdown of how it was calculated. Keep copies of everything, including WhatsApp messages. A written request often settles the matter, and it becomes evidence if it doesn't.
Step 2: Gather your documents
- Your employment contract (you can view it on the Qiwa platform)
- A copy of your iqama
- Payslips or bank statements showing your salary
- Your resignation or termination letter
- Messages and emails with the company
Step 3: File for amicable settlement
Every labour dispute starts with a free amicable settlement at the Ministry of Human Resources. You can file online through the Ministry's e-services or the Qiwa platform, logging in with your Absher/Nafath account, call the Ministry's helpline on 19911, or visit the labour office. The Ministry invites both sides to settlement sessions, usually within about 21 days.
Step 4: Labour court, if needed
If no settlement is reached, the case is referred to the labour court electronically. You can follow it on the Ministry of Justice's Najiz portal using the reference number you receive.
Don't miss the 12-month limit
Labour claims are generally not accepted after 12 months from the end of the employment relationship, unless the court accepts your excuse. Start as soon as you can, ideally before you leave Saudi Arabia.
Where to get help
Your country's embassy or consulate in Saudi Arabia usually has a labour or community welfare section that can guide you for free. If you're a domestic worker, such as a house driver, disputes go through a separate route on the Musaned platform.
