Kuwait Gratuity After 5 Years of Service (2026)

Five years is the biggest milestone in Kuwait gratuity. Under Article 51 of the Kuwait Labour Law, your Kuwait gratuity after 5 years switches to a higher rate: the first 5 years earn 15 days' wages per year, but every year after the fifth earns a full month's salary. And if you resign, Article 53 raises your share from half to two-thirds at the 5-year mark. On a KD 500 basic salary, exactly 5 years of service gives KD 1,442.31 if you are terminated — every step is worked out below.
Why 5 years is the magic number for Kuwait gratuity
Two separate things change at the 5-year mark, and workers often mix them up. Keep them apart and the Kuwait gratuity after 5 years rules become simple:
- The base rate doubles (Article 51). Years 1–5 earn 15 days' wages per year; year 6 onwards earns 30 days (one full month) per year.
- The resignation share improves (Article 53). Resign with 3–5 years and you get half the award; resign with 5–10 years and you get two-thirds.
Both changes hit at the same point, which is why the Kuwait gratuity after 5 years feels like a jump — it is two jumps stacked on top of each other.
The Article 51 formula at the 5-year mark
The Kuwait gratuity after 5 years is calculated with the standard Article 51 formula of Labour Law No. 6 of 2010. Daily wage = basic salary ÷ 26 (Kuwait uses a 26-day divisor):
- Years 1–5: (basic salary ÷ 26) × 15 days × 5
- Year 6 onwards: one full month's basic salary × each additional year
- Cap: 18 months of salary, no matter how long you served
Only basic salary counts — allowances are excluded. Read our basic vs gross salary guide if your payslip splits the two.
Worked example: KD 500 salary — 5 years vs 6 years
Let's compare Kuwait gratuity after 5 years with 6 years, on a KD 500 basic salary, for both termination and resignation:
| Scenario | Base award (Article 51) | Resignation share (Article 53) | You receive |
|---|---|---|---|
| 5 years, terminated | (500 ÷ 26) × 15 × 5 | Full | KD 1,442.31 |
| 5 years, resigned | KD 1,442.31 | Two-thirds (5–10 yrs) | KD 961.54 |
| 6 years, terminated | KD 1,442.31 + KD 500 | Full | KD 1,942.31 |
| 6 years, resigned | KD 1,942.31 | Two-thirds (5–10 yrs) | KD 1,294.87 |
| 4 years, resigned | (500 ÷ 26) × 15 × 4 = KD 1,153.85 | Half (3–5 yrs) | KD 576.92 |
Notice the cliff: resigning at 4 years gives KD 576.92, but waiting until the 5-year mark and resigning gives KD 961.54 — 67% more for a few extra months. That is the real power of the Kuwait gratuity after 5 years milestone.
What if you resign just before 5 years?
This is the most expensive mistake workers make. The Article 53 brackets are strict: 3 to under 5 years means half; 5 to under 10 years means two-thirds. Resigning at 4 years and 11 months still lands you in the 50% bracket on the smaller 15-days-per-year base.
One exception: if you resign because your employer violated the contract or the law — for example, keeping your passport — Article 48 entitles you to the full indemnity regardless of service length. Document the violation before you resign.
Partial years count — don't round down
Kuwait calculates gratuity pro-rata: part of a year counts in proportion (confirmed by multiple Kuwait labour law guides). So 5 years and 6 months is not treated as 5 years — the extra 6 months earn half a year's rate. When you use our Kuwait gratuity calculator, enter your exact start and end dates rather than rounding.
What to do at the 5-year mark
If you are approaching 5 years in Kuwait, run this checklist before making any move:
- Calculate your exact Kuwait gratuity after 5 years with the formula above — know your number before you negotiate or resign.
- Confirm your basic salary figure from your contract, not your total payslip.
- Check whether your contract is indefinite (open-ended) — the Article 53 resignation brackets apply to indefinite contracts.
- Never sign a final settlement you haven't verified line by line.

Frequently asked questions
How much gratuity do I get after 5 years in Kuwait?
On a KD 500 basic salary, exactly 5 years gives KD 1,442.31 if terminated — (500 ÷ 26) × 15 × 5. If you resign at 5 years, Article 53 gives you two-thirds: KD 961.54. Scale the KD 500 example to your own basic salary.
What changes at 5 years of service in Kuwait gratuity?
Two things: the Article 51 base rate doubles from 15 days per year to one full month per year, and the Article 53 resignation share rises from half to two-thirds. Both changes make 5 years the most valuable milestone.
If I resign after 5 years in Kuwait, do I get full gratuity?
No — resigning with 5 to under 10 years of service gives you two-thirds of the full award under Article 53. You only get the full amount after 10 years, or if you are terminated rather than resigning.
Is 5 years enough for full gratuity in Kuwait?
Only if your employment ends by termination or contract completion — then yes, any service length gets the full Article 51 award. But if you resign, you need 10+ years for the full amount; at 5 years you get two-thirds.
How is gratuity calculated for 6 years in Kuwait?
First 5 years: (basic salary ÷ 26) × 15 × 5, plus one full month's salary for year 6. On KD 500 basic: KD 1,442.31 + KD 500 = KD 1,942.31 if terminated; KD 1,294.87 if you resign (two-thirds).
