Short answer

If your employer is not paying gratuity in Oman, calculate what you are owed, then ask HR for a written breakdown. If they still do not match, file an Oman gratuity complaint with the Ministry of Labour — at their office or online. Never sign a “received in full” paper before the money is in your account.

Your contract is over and your bags are packed — but the gratuity money you earned over years of hard shifts never arrives. If your employer is not paying gratuity in Oman, the fear sitting in your chest is real. But so are your rights.

The good news: Oman labour law is clear, and there is an official route to your money. This guide explains what to do when an employer is not paying gratuity in Oman: how much you are owed (with real OMR numbers), what the law says, and how to file a complaint that gets answered.

First, know your number: what an employer not paying gratuity in Oman actually owes you

Before you talk to HR or file anything, work out your gratuity yourself. Oman has two formulas, and your contract date decides:

Both use your last basic salary only — no allowances, overtime or bonuses; partial years pro-rata. See old vs new contract rules in Oman.

A quick example: employer not paying gratuity in Oman — OMR 500 basic × 6 years

Example: OMR 500 basic, 6 years:

  1. New contract (from 31 July 2023): 500 × 6 = OMR 3,000.
  2. Old contract: first 3 years (500 ÷ 30) × 15 × 3 = OMR 750; next 3 years 500 × 3 = OMR 1,500.
  3. Old-contract total: 750 + 1,500 = OMR 2,250.

A OMR 750 gap from the contract date alone — run your dates on our free Oman gratuity calculator.

Why some employers delay or underpay gratuity

Most cases of an employer not paying gratuity in Oman are not accidents:

Your rights when an employer is not paying gratuity in Oman

Royal Decree 53/2023, Article 61: employers must pay at least one month’s basic salary per year of service on the last basic wage, fractions counted. Earlier service: 15 days per year for 3 years, then one month per year.

If your end of service benefits Oman calculation shows a clear figure and the company still will not pay, the law is on your side.

Step 1 — calculate your own amount before any meeting

Do this today, before you speak to anyone at the company. Open the Oman gratuity calculator, enter your dates and last basic salary, choose the contract type, and screenshot the result — every conversation starts from this number.

⚠️ Important: use your basic salary, not the payslip total. On OMR 500 basic with OMR 700 total, your case is built on OMR 500.

Step 2 — ask HR for a written breakdown, politely and in writing

Start with a polite written request — an email or WhatsApp message you can keep:

“As-salamu alaykum. My contract ended on [date]; under Oman labour law my gratuity is [OMR figure] for [X] years at OMR [basic] basic. Please share the company’s written calculation so we can settle this week.”

If their figure is lower, ask which salary figure and contract-date formula they used — the gap is usually one of those two. Save every reply.

Step 3 — build your evidence file

If polite asking fails, your evidence file makes the complaint strong. Gather these now:

Photograph everything — papers left in an office drawer are gone forever, and so is your proof.

Step 4 — file your Oman gratuity complaint with the Ministry of Labour

If the company will not pay after a written request, file an Oman Ministry of Labour complaint — the route is official and open to every worker:

Bring or upload your evidence file, ID/passport copy, and a one-page summary: name, company, service dates, last basic salary, amount owed, and what the company said. The labour department then tries to settle — most cases end at mediation.

The department contacts the employer and attempts a settlement — many pay when the official letter arrives; if none is reached, the case moves onward. Never withdraw until the full amount is in your account.

⚠️ Watch out: three traps that cost workers their gratuity

Leaving Oman soon? Your gratuity right travels with you

Visa cancellation or a final exit does not cancel what you earned. If your employer is not paying gratuity in Oman and your flight is next week, file before you leave and keep your evidence file on your phone — your right to what you earned does not disappear at the airport.

Last-week plan: calculate your figure, get the company’s breakdown in writing (check notice period in Oman if you resigned), photograph every document, and file before your exit.

How long does it take?

Simple cases often settle within weeks once the Ministry contacts the employer. What speeds things up: a clean evidence file, a correct calculation, fast replies. What slows things down: missing payslips, a wrong salary figure, waiting months. Start today.

Remember: when an employer is not paying gratuity in Oman, silence is the most expensive option. Calculate your figure, ask in writing, keep your papers — and file with the Ministry if the company will not pay.

Frequently asked questions

How do I complain about unpaid gratuity in Oman?

Calculate your amount with the Oman gratuity calculator, ask your employer for a written breakdown, then file with the Ministry of Labour — at their office or via their online complaint service. Bring your contract, payslips, bank statements and EOSB calculation.

Can I file a complaint if my employer is not paying gratuity in Oman after I resign?

Yes — resignation with notice served does not reduce your Oman gratuity. If the company refuses to pay: written request first, then a Ministry of Labour complaint with your evidence file.

What documents do I need for a gratuity complaint in Oman?

Your contract, last 12 payslips, bank statements of salary credits, leave balance, your EOSB calculation, and copies of anything signed. Photograph everything.

How long does a gratuity complaint take in Oman?

Simple cases often settle within weeks once the Ministry contacts the employer. Keep your evidence file complete and reply quickly.

Do I lose my gratuity if I leave Oman without complaining?

Your right to earned gratuity does not vanish when you leave, but chasing it from abroad is much harder. File before your exit and keep your evidence file on your phone.
