Amir works 20 hours a week at a Dubai store. After four years, HR hands him a final settlement with zero gratuity: "Gratuity is only for full-time staff." He signs — he needs the money — and loses about AED 7,000 he was legally owed. If you work part-time in the UAE, this story is about you. UAE part-time worker gratuity is not a favour; it is a legal right, calculated like full-time gratuity and scaled down by your hours. This guide gives you the formula, the law, worked examples, and the five tricks employers use to pay less.

Short answer

Part-time workers earn gratuity like full-time workers — then it's scaled by hours worked. Formula: (your annual contracted hours ÷ full-time annual hours) × 100 = your work percentage; part-time gratuity = full-time gratuity × that percentage. You need one year of continuous service; the 2-year cap still applies.

The short answer: yes — UAE part-time worker gratuity is a legal right

Many part-time workers assume they get nothing when they leave — a costly mistake. Federal Decree-Law No. 33 of 2021 recognises part-time as a proper work pattern with the same rights as full-time workers, pro-rata: leave, overtime protection, gratuity. On the mainland under MOHRE, you're covered. (DIFC and ADGM differ.) Understanding UAE part-time worker gratuity before you sign is essential.

Important: your contract must say "part-time". If paper and timesheets disagree, real hours count — see the watch-outs.

The law behind the UAE part-time worker gratuity formula

The rule sits in Cabinet Resolution No. 1 of 2022, Article 30. It gives a five-step method for part-time and job-sharing workers:

  1. Take the total annual working hours written in your part-time contract.
  2. Take the full-time annual working hours for a comparable role in the same company.
  3. Divide the first number by the second and multiply by 100 — that is your work percentage.
  4. Calculate the full-time gratuity using the normal UAE gratuity formula.
  5. Multiply the full-time figure by your work percentage — that is your UAE part-time worker gratuity.

One hard limit: temporary workers, or anyone under one year of service, get no end-of-service benefit.

The UAE part-time worker gratuity formula, step by step

In plain words, using the standard full-time reference of 2,080 hours a year (8 × 5 × 52):

Watch out: 2,080 is the standard reference, but your employer may define full-time hours differently. Always use the full-time annual hours written in your contract for step 2 — that number decides your percentage.

Worked example 1: AED 5,000 basic, 20 hours a week, 4 years of service

Amir's case, step by step:

  1. Annual hours: 20 hours × 52 weeks = 1,040 hours
  2. Full-time annual hours: 2,080 hours
  3. Work percentage: 1,040 ÷ 2,080 × 100 = 50%
  4. Daily wage: 5,000 ÷ 30 = AED 166.67
  5. Full-time gratuity: 166.67 × 21 days × 4 years = AED 14,000
  6. Part-time gratuity: 14,000 × 50% = AED 7,000

That is the AED 7,000 Amir lost by signing without checking — his UAE part-time worker gratuity in this example. Run the same five steps with your own numbers, or use our free UAE gratuity calculator, before you sign anything.

Worked example 2: AED 8,000 basic, 32 hours a week, 7 years of service

A longer-service case where the 30-day band kicks in:

  1. Annual hours: 32 × 52 = 1,664 hours
  2. Work percentage: 1,664 ÷ 2,080 × 100 = 80%
  3. Daily wage: 8,000 ÷ 30 = AED 266.67
  4. First 5 years: 266.67 × 21 × 5 = AED 28,000
  5. Next 2 years: 266.67 × 30 × 2 = AED 16,000
  6. Full-time gratuity: 28,000 + 16,000 = AED 44,000
  7. Part-time gratuity: 44,000 × 80% = AED 35,200

The same base rule as how UAE gratuity is calculated for full-time staff applies first; the hours percentage only touches the final figure.

Full-time vs part-time gratuity: side-by-side comparison

Basic salaryServiceHours/weekWork %Full-time gratuity (AED)Part-time gratuity (AED)
5,0004 years2050%14,0007,000
8,0007 years3280%44,00035,200
3,5002.5 years1640%6,1252,450
10,0006 years2460%45,00027,000

Two patterns stand out. First, your hours percentage is the biggest lever — dropping from 40 to 16 hours a week cuts the award to 40% however long you served. Second, longer service still pays: the 30-day band after year five lifts the full-time base, and the percentage scales that bigger number. That is how UAE part-time worker gratuity rewards both hours and loyalty.

The base rules are exactly the same as full-time gratuity

The hours percentage is the only difference. Underneath, the standard UAE labour law gratuity rule applies:

Each of these can cost you thousands of dirhams.

UAE part-time worker gratuity checklist: is your contract really part-time?

Five questions before accepting any figure: (1) Does your MOHRE contract say part-time? (2) Do your real hours match it? (3) Was the contract's full-time figure used for your percentage? (4) Is the daily wage from your last basic salary? (5) Is the total under the 2-year cap? Any "no" — get it in writing and don't sign.

Check your own number in five minutes

You don't need a lawyer to check your figure. Write down your last basic salary from a recent payslip (allowances stripped out), count your continuous service in years and months, work out your hours percentage, and run the five steps — or let our free UAE gratuity calculator do it. This five-minute check protects your UAE part-time worker gratuity. If the employer's number differs, ask for their written calculation, and never sign a final settlement you don't fully understand.

Frequently asked questions

How is gratuity calculated for part-time employees in UAE?

Calculate full-time gratuity first (last basic ÷ 30 × 21 days/year for 5 years, then × 30/year), then multiply by your work percentage: contracted annual hours ÷ full-time annual hours × 100. That is your UAE part-time worker gratuity.

Do part-time workers get gratuity in UAE if they resign?

Yes. Resignation does not reduce gratuity — part-time workers who resign after one year get the same pro-rata award as if terminated.

What is the minimum service for part-time gratuity in UAE?

One year of continuous service with the same employer. Probation counts once you are confirmed. Temporary models under a year get nothing.

Is part-time gratuity calculated on basic salary or total salary?

Last basic salary only. Allowances are excluded; daily wage is basic ÷ 30 — the same base rule as full-time staff.

What if my contract says part-time but I work full-time hours?

Keep your own records — rosters, entry logs, payslips. The part-time rate needs both the contract and the real pattern behind it. If they insist, complain to MOHRE — see employer not paying gratuity in the UAE.
